law

A 22-year-old Trillick woman took scratchcards from a dispenser in a filling station and ripped them up before leaving the premises.

Shauna Murphy of Woodview Crescent also refused to pay for a bar of Twix she took despite carrying enough money for the items.

At Enniskillen Magistrates Court she admitted charges of theft and disorderly behaviour arising out of the incident.

The court was told the defendant claimed she could remember little about the events of the early morning incident because she was drunk at the time.

She agreed to a one year probation order and to participate in an alcohol awareness programme.

The court was told that Murphy went into Lakeside Service Station on Queen Street, Enniskillen at approximately 2.50am on New Years Day and “grabbed” four scratchcards, tore them up refused to pay for them.

She also lifted a bar of Twix and began to eat it without paying. The value of the cards and chocolate bar came to £8.81.

When police arrived, staff told the officers they would be “happy” if she paid for the items. However, she refused and left the premises and told police officers to “f*** off.”

She claimed she did not have the money, but it subsequently emerged she had enough money on her person to pay for the goods. She was arrested and in the police car kicked out at the rear driver’s window.

Her defence solicitor, Michael Fahy submitted that his client’s previous record was “not extensive.” He suggested her behaviour was “bizarre and was not premeditated.”

He told the court she had been out on New Year’s Eve and the pre-sentence report indicated she had “no recollection” of the events that occurred at the service station.

Mr Fahy added: “She is extremely ashamed and accepted culpability without reservation.” He added that Murphy paid the money to the service station shop within days.”

District Judge Sean O’Hare described the defendant’s behaviour as, “inexcusable and reprehensible.”

He acknowledged she made full restitution, and said it appeared she needed “help with her alcohol problem.”
