Driving ban after two cans of beer

A LEARNER driver who drove an uninsured car from Lack to Kesh after drinking has been disqualified from driving.

Dailis Upitis (25) with of Culmore Park in Omagh appeared at Enniskillen Magistrates Court on Monday where he pleaded guilty to drink driving, driving without insurance, and unaccompanied driving. 

At around 12.20am on Saturday, March 26 police stopped a blue Vauxhall Astra being driven by Upitis on the Kismullen Road outside Lack. They noticed his breath smelled of drink, that he had no L plates displayed, and that he was not accompanied by a qualified driver.

Upitis, who has been living in the jurisdiction for eight years, failed a roadside breath test and when taken to the police station returned a reading of 42 micrograms of alcohol per 100ml of breath. 

Upitis defence solicitor said he had only bought the car two days before hand and had two cans to drink on the night he was stopped. She said it was his cousin’s birthday and he foolishly took the decision to drive to Kesh to see him. 

The solicitor added Upitis had already got insurance quotes for the car, and was planning on taking out the policy when he got paid the following week.
Deputy District Judge Peter King disqualified Upitis a total of 12 months and fined him £350 for the three charges.
