Fined for unapproved windows on listed building

A LOCAL company has been fined and ordered to replace windows on a house it bought after they were installed without permission by the previous owners.
Local company BM Commercial Properties Limited, which has an address on the Sligo Road, were fined at Enniskillen Magistrates Court on Wednesday for failing to comply with an enforcement notice.
The notice had initially been served on BM Properties, which the court was told was a small family-run company, in October last year in relation to a house at Willoughby Place in Enniskillen. The windows of the three-storey Georgian house had been replaced with new PVC frames on the first and second floor, which were not permitted as it was a listed building.
BM Properties were ordered to replace the PVC with wooden sash-style windows, in keeping with the period of the property within 28 days but the company failed to comply.
Handing in a written quote to District Judge Michael Ranaghan, defence solicitor Barry Lynam said the required remedial work would cost the company “not an inconsequential amount.”
Mr Lynam told the court BM Properties had not installed the PVC windows, which were already there when they bought the property.
He added while the windows were made from PVC, their design fit the property.
Judge Ranaghan said now a conviction for not complying with the order had been recorded in court every day the company failed to replace the windows become a continuing offence.
Mr Lynam said BM Properties appreciated it was “a live issue” and would carry out the work as soon as possible.
Judge Ranaghan, who noted the early guilty plea and the fact that the windows were not significantly different from the property, fined the company £400 and ordered it to pay £50 court costs.
“They need to concentrate on getting that work done,” the judge concluded.
