A LISNASKEA man, who was stopped by police after driving at 15 miles per hour, has been disqualified from driving for failing to provide police with a breath sample for testing.
Louis Traynor (42) from Main Street, Lisnaskea was charged with failing to provide a breath specimen after being arrested on suspicion of drink driving on November 23.
Enniskillen Magistrates Court heard last week that Traynor had been stopped after police observed him driving at the slow speed on the Tempo Road, Enniskillen and swerving across the central white line. Traynor failed to provide the officers with a sample of his breath for testing, and gave them no medical reason for not doing so.
Defence solicitor Garry Smyth said, although Traynor did not say so to police, the defendant had had breathing difficulties in the past. Mr Smyth, who handed in a letter to the court from Traynor’s GP, said the unemployed electrician had made attempts to give a breath sample, but his attempts were unsuccessful.
Asking the court to take into account Traynor’s early guilty plea, Mr Smyth appealed for leniency, explaining any driving ban would limit the defendant’s prospects of getting back into employment.
District Judge Nigel Broderick said he would give Traynor credit for his plea, but the court had no way of determining how much alcohol was in his system said he had one relevant previous conviction, albeit from 2002. Judge Broderick disqualified him from driving for 16 months and fined him £200.
