QUINN Building Products Limited face criminal proceedings following the tragic death of Fermanagh footballer Brian Og Maguire in 2012.
The 24-year-old former Lisnaskea Emmett’s man lost his life in an industrial work accident at the Quinn Building Products factory in Ballyconnell on September 13, 2012.
Over two and half years on a case has been brought against the Quinn company and the firm faces two charges in relation to safety at the factory.
On Monday Quinn Building Products Limited director Liam McCaffrey appeared at a preliminary enquiry in Enniskillen Magistrates Court to face the charges, while members of the Maguire family were seated in the body of the court to hear proceedings.
The Quinn company stands accused that on September 13, 2012 they as employer, failed to ensure, so far as was reasonably practicable, the health, safety and welfare at work of all their employees, including, in particular – the provision and maintenance of plant and systems of work and, the provision of such information, instruction, training and supervision as was necessary to ensure, so far was as reasonably practicable, the health, and safety at work of employees.
The company faces a second charge that on the same date they failed to ensure that work equipment involved in the production of pre-stressed concrete, was maintained in an efficient state, in efficient working order.
The court prosecutor stated that Quinn Building Products Limited had a case to answer and the defence made no contrary submissions. District judge Nigel Broderick was satisfied there was a prima facie case to answer.
When asked if he wished to say anything to the charges Mr McCaffrey replied: “Not at this stage”. When asked if he wished to call any witnesses on the company’s behalf or give evidence himself he again responded: “Not at this stage”.
The matter is to be returned to Dungannon Crown Court for arraignment on Wednesday July 1. The court heard that Mr McCaffrey will be out of the jurisdiction on that date, but that another director would attend the hearing on the company’s behalf.
