A GARRISON man who had his sentence for disorderly behaviour deferred for 12 months has been handed a four month suspended prison sentence after the court heard there had been no offending in the intervening year.

James Patrick Thomas Doherty (21) from Devenish Park, Garrison, appeared before Enniskillen Magistrates Court for sentencing a year after he admitted disorderly behaviour at the Erne Hospital in Enniskillen.

The court heard details of the incident which occurred on June 8, 2012 when  police were called to the defendant’s address in connection with a medical emergency.

An ambulance was at the scene but the defendant refused to get into the ambulance or to co-operate with ambulance staff.

“If I had a f***** gun I’d kill you all.

Police took the defendant to the emergency department of the South West Acute Hospital where he swore at officers and other members of the public in the waiting area. This disorderly behaviour continued throughout the night
The court heard this was a case in which sentence had been deferred for a year to see if the defendant could stay out of trouble.

District Judge Nigel Broderick said there was a very positive report from probation and no indication of re-offending.
The judge said this was a serious matter especially as it happened within the context of a hospital setting.

“The courts take a very dim view of such behaviour” the defendant was told.

“This sentence was deferred for one year and I am very encouraged to read a positive report. You have addressed you difficulties very well.

The judge noted the defendant had complied fully with the probation order and as such was minded to suspend his sentence.

“Hopefully the good work you have embarked on will continue,” the judge added.
