A pensioner collided with a bin lorry after he took his eyes off the road to look at a horse, Enniskillen Magistrates Court heard on Monday.
Thomas MacCrory (76) of Tullyneil Court in Sixmilecross was charged with careless driving on August 8th at Loughshore Road, Enniskillen.
The court heard that police were called to a two vehicle collision at 2.15pm that afternoon involving the bin lorry and the defendant’s blue Toyota Avensis.
On arrival at the scene, police found that was damage was caused to the front tyre of the bin lorry and to the front and side of MacCrory’s car after he veered across the white line, leading to the collision.
The defendant sustained small cuts to his arm and above his eye.
He was arrested for careless driving and in a police interview he told officers that the road had been damp at the time and he had noticed that he was too close to the white line before the accident.
Defence solicitor Sean McHugh said his client had been returning from Bundoran at the time.
“He is a retired agricultural contractor and his attention was drawn to a horse, causing his eyes to linger off the road for longer than is advisable.
It was a lapse of concentration on his part that he now regrets and has been a lesson for him as he ensures that he concentrates on the road ahead.”
District Judge Nigel Broderick imposed a £250 fine and gave him six penalty points.
