An Enniskillen van driver has been convicted of carry a load almost 70 per cent over the weight allowed.
Oliver Patrick McShea (45) of Lawnakilla Park was fined £315 when he appeared at the Magistrates Court on a charge of using a vehicle with excess weight.
On the morning of September 13 last year, police stopped a Mercedes van that appeared to be heavily laden. They discovered it contained glazing units weighing 5,740 gross kilograms. However the legal weight limit for a load on the van was 3,000 kgms.
When cautioned for the offence, McShea made no reply.
The court was told he had been employed by a firm for over 26 years and for the last six months he had been doing deliveries.
He claimed on the morning in question, he received an “urgent” order and the Mercedes van was the only vehicle available.
A defence solicitor said his client did not know the limit for the van and that, if he had known he would have used another vehicle. The solicitor added that there was no weigh bridge at the company
He described McShea as, “an upstanding member of the community.”
District Judge Liam McNally said he acknowledged the defendant had a “long clear record” and had admitted the offence at the first opportunity. But, he added that the load on the van was “well overweight.”
