A twenty-six year old man who slammed a door in a pub causing injury to a woman’s hand has been ordered to pay compensation and has been given a suspended custodial sentence.
Kalem Dorian of Castle Island, Broadmeadow Place, Enniskillen was charged with assault occasioning actual bodily harm at Enniskillen Magistrates Court on Monday.
The prosecution outlined that on 26 February 2018 Police received a report that a door had been slammed on a woman’s hand in the Cornerstone Bar, Enniskillen. Dorian was pointed out and Police arrested him. Ten months after the incident the injured party provided a statement that her hand was still in pain and visibly discoloured.
Defence barrister Ciaran Roddy remarked that this was a serious matter, leaving the injured party with issues in the aftermath.
It was said Dorian accepted the charge against him but that he did not have a recollection of it. Mr Roddy added that the injured party was not known to Dorian and claimed this was not a premeditated incident but rather occurred due to his intoxicated state. Mr Roddy also outlined that Dorian’s mother and partner are appalled by the incident.
District Judge Steven Keown said this had clearly passed the custody threshold, and the question was whether Dorian would go into custody today (Monday) or not. He added that Dorian’s record was nothing to be proud of.
Judge Keown gave Dorian credit for not fighting the case adding it was an extremely serious case with injuries. Dorian was ordered to pay £750 compensation with offender levy £15. Judge Keown also handed Dorian an eight month suspended custodial sentence.
