A 53-year-old man has avoided prison after being convicted of assaulting a 75-year-old man in front of his wife on a roadside.
Vincent Barlow of Blunnick Road, Florencecourt was convicted after contest of unlawfully assaulting Brian Taylor on 10th September last.
Enniskillen Magistrates Court heard on Monday that at 6pm on the date in question, the injured party was driving along the Blunnick Road at 30mph with his wife in the car when he was overtaken by a black Mercedes.
The car came to a halt and Barlow got out of the car and approached the injured party’s vehicle.
He began shouting and swearing before putting his hand through the driver’s window and punching Mr Taylor who was left with a nose bleed.
Barlow then walked off from the scene and when later questioned by police, he said he had overtaken Mr Taylor because he had been driving at 15mph.
Defence solicitor Tommy Owens said his client suffered with mental health issues and wished to express his regret and remorse for what had occurred.
District judge Michael Ranaghan described the incident as “an unprovoked attack” as he imposed a three month sentence, which given the severity of the assault, he would suspend for a lengthy period of two years.
