AN Enniskillen man who recorded an ‘atrocious’ reading has been disqualified from driving for two years.
Sean McGaghey (42), of Derryaghna Road, Enniskillen appeared at Enniskillen Magistrates Court on Wednesday charged with drink driving and driving with no insurance.
On August 12th around 6.30pm, Police received a report from a member of the public about a man driving a Toyota Avensis on the Sligo Road, Enniskillen. When Police stopped the defendant, they carried out a breath sample and McGaghey returned a evidential reading of 121 micrograms of alcohol per 100ml of breath – three times over the legal limit. They also found that the vehicle was not insured.
Defence counsel Gary Smyth told the court that it was a high reading, and that the defendant had consumed alcohol in the afternoon and did not have much to eat. He also told the court that the car was previously insured, but that the policy had ‘lapsed.’
McGaghey who is a joiner by trade, has no previous convictions and entered an early guilty plea.
Mr Smyth also told the court how the loss of his licence would impact on his employability and asked for leniency for his client whose ‘embarrassment is acute.’
District Judge Nigel Broderick said “it was an atrocious reading, and he could have killed himself or someone else. A car becomes a deadly weapon when you are so intoxicated.”
Judge Broderick disqualified McGaghey from driving for two years, to be retested and fined him £300 for drink driving. He was also disqualified and fined £100 for having no insurance.
