A 26-year-old man damaged the window of a property causing over £90 of damage in a row over a cigarette.
Enniskillen Magistrates Court heard that police were contacted by the injured party Michael Carey, who claimed that Paul Moran had smashed a window of his property on December 30th last. When police arrived at the scene, they found Moran outside the property with blood on his hand.
Moran, of Derrin Park in Enniskillen, was arrested for causing criminal damage and when questioned by police, he admitted breaking the window but not the glass. The court heard that he took the action because Carey wouldn’t give him a cigarette.
Defence solicitor Niall Bogue told Monday’s sentencing hearing that his client hadn’t essentially set out to break the window. Mr Bogue pointed out that his client had mental health issues and was in breach of a suspended sentence for a similar offence but had been engaging with the relevant services and his GP.
District Judge Nigel Broderick said he recognised that the defendant struggled with mental health issues and would not be sending him to prison.
Moran was sentenced to three months in prison, suspended for three years. He also ordered him to pay £93.54 in compensation for the broken window.
