A CLABBY man has been given penalty points after hitting into a car when he pulled out too far at a junction.
Dean Farrell (29) of Clabby Road, Clabby appeared at Enniskillen Magistrates Court on Monday charged with driving with due care and attention on the Clabby Road.
On November 22nd 2018, around 8pm police were called to a slight injury road traffic collision on the Clabby Road in Tempo involving a Toyota Hilux and another vehicle.
The court heard that Farrell was approaching a junction, and the onus was on him to give way on the Drumcor Road, but he pulled out too far from the junction, and hit into another vehicle.
The injured party was taken to hospital, where she spent the night and was stiff and sore after the accident.
Defence counsel for Farrell apologised for the injuries sustained in the accident, adding he was coming back from a friend’s house, it was dark and Farrell was travelling towards the Drumcor junction and misjudged when he came to the junction.
The court heard Farrell had been dazzled by lights of an oncoming vehicle and found himself half way across the road. The defence added Farrell’s insurance company was dealing with the claim and the defendant made admission at the scene of the accident.
District Judge Michael Ranaghan said the aggravating factor was the injuries sustained but added he was not going to disqualify Farrell from driving giving him full credit for his actions at the scene and his admission.
Judge Ranaghan gave him seven penalty points, and fined him £200.
