A 34-year-old Enniskillen man imprisoned for a host of offences in Fermanagh is also wanted by the authorities in his native Lithuania.
Sergej Dyman, of Woodview appeared via videolink at Enniskillen Magistrates Court where it was revealed Lithuanian authorities are seeking a European arrest warrant to have the defendant extradited.
In court the prosecutor outlined the charges against the defendant in this jurisdiction. On Saturday July 11, 2015 at 11.40pm police received a report of an incident on Darling Street, Enniskillen. The man who reported the incident advised that noises could be heard from a flat above a shop, known to be unoccupied for several years. When he went to check on the disturbance in the upstairs apartment he found a male upstairs in the toilet. Officers arrived and located Dyman lying sleeping with a blanket over him.
Police noted a glass windowpane had been broken in an upstairs room and observed fresh excrement in the toilet, despite the building having no running water. Cigarette butts and papers were scattered along the floor with the bathroom window suspected as the point of entry. In this area a slate was located with blood on it and forensics tests matched this to the defendant.
Dyman was arrested and then interviewed. He denied the offences, but admitted using the toilet. He told police there was nothing that could have been damaged in the flat as it was in a bad state of repair and said he had entered the flat through an open rear door. On the night in question Dyman said he was trying to find somewhere to sleep for an hour as he was drunk.
In another incident on December 6, 2015 at 8.20pm police received a report of a theft of two bottles of alcohol from McBride’s Spar shop, Coa Road, Enniskillen. A half bottle of whiskey and a bottle of rum valued at £25.68 were taken valued by male later identified by CCTV as the defendant. During a later interview Dyman denied he was the person on the CCTV. He was bailed, but did not appear for police when instructed to do so.
The prosecutor further outlined that between February 1 and February 2, 2016 Dyman entered the Nisa shop in Tempo on three separate occasions and each time stole a bottle of whiskey, which he concealed under his jacket when paying for items of lesser value. The total value of the three thefts was £54.99. None of the items stolen were fit for re-sale.
The court also heard that on December 12, 2015 the defendant damaged an electronic tag belonging to G4S, estimated at £165 in value. Dyman removed the tag and two days later police located it at an address in Kilmacormick Drive.
Defence solicitor Garry Smyth highlighted that his client entered guilty pleas to all matters and said he adopted a “pragmatic approach” to the charges.
The defence said his client had been in Fermanagh for 18 months and was a qualified welder, with extensive experience in the construction trade. He accepted Dyman had issues with alcohol, which had influenced his offending.
District judge Nigel Broderick gave the defendant credit for his guilty pleas, but due to the number and nature of offences said the custody threshold had been crossed. He sentenced Dyman to five months imprisonment.
