A DONEGAL drug addict who was found with heroin while driving through Enniskillen has been fined.
Stephen Heraty (29) of Finner, Ballyshannon appeared at Enniskillen Magistrates Court on Monday
On Saturday, October 1, 2011 police driving on the Sligo Road, Enniskillen were overtaken by a car with a southern registration, which was accelerating. They signalled for the car to stop, and Heraty pulled over.
The defendant admitted to the police he was a drug user and a search of the car uncovered a spoon with traces of heroin on it. A syringe was also found in the car. The court was told Heraty, who had a relevant previous conviction in the south, had made full admissions at the scene and the drugs were for personal use only.
Heraty’s defence barrister said the defendant suffered from addiction difficulties, despite growing up in a stable environment.
The barrister said poor life choices, experimental use and negative peer influences had lead to his problems with addiction.
The barrister said Heraty, who appeared in court via video link from prison where he has been remanded on separate charges, had benefited from the strict formal approach to dealing with his problem while in jail.
District Judge Nigel Broderick fined Heraty £250 and issued a destruction order for the heroin.
