A GRANDFATHER who was stopped speeding while leaving his grandchildren to a party was found to be uninsured after he volunteered his driving documents to police.
Cyril Rusk (66) from Knockballymore Road, Magheraveely, pleaded guilty to speeding and driving without insurance at Enniskillen Magistrates Court on Monday, having been detected driving at 42mph in a 30mph zone on the Moorlough Road, Newtownbutler at approximately 2pm on November 21.
Rusk had been driving his daughter’s car and was leaving his grandchildren to a party. When stopped by police he said he “wasn’t thinking.”
The matter would’ve been dealt with by way of a fixed penalty for speeding, and only came before the court after it emerged he was uninsured.
Defence solicitor Michael Fahy said it only became apparent Rusk was not insured when he voluntarily gave the police his insurance documents.
Mr Fahy explained Rusk, who had no previous convictions, had been continually insured in full for over 20 years, and had assumed the insurance policy, which had third party vehicle coverage, would entitle him to drive the car. However, as his own insurance was commercial it did not cover him to drive a private car.
District Judge Nigel Broderick fined Rusk, a self-employed farmer, £60 for speeding, £200 for having no insurance, and gave him a total six penalty points.
