‘Distressed’ woman fled scene after causing collision

A WOMAN who reportedly caused a three-car collision panicked and fled the scene as she did not have a valid MOT, a court has heard.

Rosemary Boyle (45) of Crom Cruaich Way, Belcoo pleaded guilty to driving without due care and attention and having no MOT at Enniskillen Magistrates Court on Monday.

On Friday, July 24 this year at approximately 4.30pm police were called to the scene of an accident on the Sligo Road, Enniskillen, near the junction of Meadow Lane. Boyle had already left the scene, and the driver of one of the three cars involved in the accident said it had been Boyle who caused the accident.

He told police she had been the third car to come along, explaining her Peugeot had “ploughed into” the back of the Citroen behind him, causing that car to crash into his Volkswagen Jeda. The female driver of the middle car had also left the scene, and had been prosecuted previously for having no insurance.

Police called to Boyle’s address following the crash, and observed her silver Peugeot 207 convertible in her driveway. The car had significant damage to it. Boyle answered the door to the police, and admitted her involvement, explaining she had panicked and left the scene as she had no test certificate for her car.

The court heard Boyle failed a police breath test at her home and was arrested, but when brought to the police station she returned a reading of 0 on the police evidenzer machine. In interview at the station, Boyle made admissions regarding her standard of driving.

Defence solicitor Emer Cox said Boyle had pleaded guilty at the earliest opportunity. Ms Cox said Boyle, who had no mobile phone, had got out of her car following the collision and spoke with the driver of the middle car, who asked the defendant to pull into a nearby cul de sac. She did so and when she returned he driver of the front car was gone.

The solicitor said Boyle, who is unemployed and the sole provider for her son, was in a very distressed state following the accident. She said Boyle’s car had failed its MOT in April this year, and she had been remiss in applying for a re-test due to personal circumstances at the time.

For careless driving, District Judge Nigel Broderick fined Boyle £250 and gave her six penalty points. He fined her a further £50 for having no MOT.
