An Enniskillen man was fined a total of £250 at Enniskillen Magistrates Court on Monday after pleading guilty to motoring offences.
Prosecutors told the hearing that at 7pm on March 29th, police on patrol on the Sligo Road in Enniskillen observed a Ford Focus travelling towards them in the opposite direction. The police officers observed that the driver, Caoimhghin Thompson, was holding a mobile phone in his right hand and appeared to be engaged in conversation.
Thompson, of Erindale, Coa Road, Cavanaleck was cautioned and a fixed penalty notice issued. As the defendant failed to produce his driving licence and MOT certificate, he was charged with having no MOT, failing to produce his driving licence and using a mobile phone while driving.
Defence solicitor Garry Smyth said his client had been on the phone at the time of his detection but was in the process of putting it onto hands free mode.
Mr Smyth said Thompson’s MOT had lapsed as he had been away and that the car involved had since been disposed of.
District Judge Nigel Broderick fined Thompson £25 for failing to produce his licence, £75 for no MOT and £150 for using a mobile phone while driving. He also received three penalty points.
