The court was told that police were on mobile patrol at Darling Street in Enniskillen on May 1st when they observed two males squaring up to one another and attempting to start a fight.

When police approached Kearney, they noted that his eyes were glazed and he was unsteady on his feet and had to use the patrol car to support himself. Kearney then attempted to push past the police to get to the two males who were fighting and became verbally abusive. He clenched his fists and punched one of the police officers in the chest area as he tried to get past them before being restrained and handcuffed.

Defence solicitor Emer Cox said that while her client had no recollection of the incident, he accepted the charges.

District Judge Nigel Broderick told Kearney : “While alcohol was clearly a major feature here, it can never be an excuse for you to behave as you did. Thankfully no injuries were sustained by the police on this occassion.”

Kearney was ordered to undertake 50 hours of community service.
