An 18-year-old Enniskillen man who urinated against a police cell door has been jailed for five months.

District judge Peter King said a custodial sentence was the “only option” for defendant Christopher Boyle, of Corban Avenue and convicted him at Enniskillen Magistrates Court.

The prosecutor outlined that on November 18, 2015 police were called to an incident in the Inishkeen Close area of Enniskillen. Officers called to the disturbance and saw two males beating up another close by. When police arrived the two ran off, with Boyle located in a nearby shed.

Boyle and his co-accused was arrested and at the station the former caused damage to his cell, flooding it and urinating against the door. Both defendants were deemed unfit for interview until the next morning.

After Boyle’s co-accused a Mr McMulkin, was charged for his offence Boyle responded: “I’m going to f****** kill him”. The injured party in the incident Patrick McDonagh was taken to hospital for treatment, but declined to make a complaint. During interview when asked if he had been assaulted the injured party said: “No”.

Defence barrister Stephen Mooney said the initial incident was a “fall out amongst criminals” and that no one could say how it had started. He said that Boyle maintained the injured party had been aggressive at the start.

The court heard that Boyle’s co-accused was jailed for the offence and the district judge said jail was the “only option” for this defendant, noting he was in breach of two suspended sentences.

The district judge said the only way Boyle could have avoided prison was if he had cooperated with probation, but despite being offered two appointments and contact made with his mother the defendant failed to do so.

The judge activated the suspended sentences imposing a total jail term of five months. The defendant has since appealed the sentence and has been released on his own bail of £250.
